A live-in relationship is cohabitation in the nature of marriage but not marriage. There is an individual freedom in the said relationship and little obligations. Unless the live-in relationship is for a long time, little can be done about the maintenance. There is no legal definition of live-in relationship and therefore the legal status of such type of relationship is also unsubstantiated. The Indian law does not provide any rights or obligations on the parties in a live-in relationship. However, in view of a very long cohabitation, the court has liberally professed that such relationship will be presumed as marriage unless proved contrary. The right to maintenance in a live-in relationship is decided by the court in accordance with the Domestic Violence Act, 2005 and the individual facts of the case.
