Whoever uses any false property mark shall, unless he proves that he acted without intent to defraud, be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.

1.Where an offence is a cognizable offence, the police officer can make arrests the accused without obtaining a warrant first from the Judicial Magistrate and can also make the investigation. Or where an offence is a non-cognizable offence, the police can neither make arrests nor initiate an investigation into a matter without first obtaining a warrant or authority to investigate from the Judicial Magistrate.
2. Where an offence is bailable or where any person accused for a bailable offence is arrested or detained without warrant by an officer in charge of a police station, or appears or is brought before a Court, if such person applies for bail then the officer in charge of the police station or the court is mandated to release such person on bail on accomplishment of duly defined surety bond that has to be executed at the concerned police station or before a magistrate or court. Or where an offence is non-bailable, the bail is not a right of the accused. A person can approach the Magistrate Court, the Court of Session or the High Court to seek bail for non-bailable offences.
3. Where an offence is compoundable, the complainant agrees to enter into a compromise and drop his or her charges against the accused. Or where an offence is non-compoundable, no compromise is permitted between the accused and the victim with the exception of under specific circumstances, where the High Court or the Supreme Court has the authority to give order for quashing a matter.
